Proposed sale of Crown land by direct negotiation in Yeoval

The Department of Planning, Housing and Infrastructure, Crown lands is assessing the proposed sale of Crown land located at 12 Myrangle Street, Yeoval NSW 2686.

Crown Lands is assessing the proposed sale of 1208.66 m2 of Crown land identified as Lot 12 Section 6 in Deposited Plan 759140 by direct negotiation to the licence holder, Yeoval and District Men’s Shed Incorporated. A sale by direct negotiation means that the department will negotiate exclusively with the licence holder for the sale of the land as opposed to offering the land for sale through a public competitive process. 

This land is currently reserved for future public requirements, however the department has assessed that it has no functional community use outside of its current licence purpose of men’s shed. A proposed sale by direct negotiation with the licence holder is being considered as the best use for the land as the land has been developed by the Yeoval and District Men’s Shed with a premises suitable for the Men’s shed user groups.

Community Engagement Strategy

Engagement on this proposed transfer is a requirement of the Community Engagement Strategy. The Strategy has been developed by the Department of Planning, Housing and Infrastructure to set an open and transparent framework for engaging the community about important decisions on Crown land. Where is the Crown land proposed for sale located?

The Crown land is identified as Lot 12 Section 6 in Deposited Plan 759140 and known as 12 Myrangle Street, Yeoval NSW 2686. The Crown land is an irregular shape and approximately 1208.66 m2 in size. 

What is the Crown land currently used for?

The land currently forms part of a Crown Reserve for future public requirements however, the land has been developed by the licence holder, Yeoval and District Men’s Shed for its use of and the use of other community groups.   

Why is the department proposing to sell this land?

The department was approached by the Yeoval and District Men’s Shed Inc with a proposal to purchase the land to remove any uncertainty about the group’s continued occupation. The Men’s Shed is a community based, non-commercial organisation which has developed the land for community use. The Men’s Shed currently occupies the land in accordance with a licence.

The department is also working with the Local Aboriginal Land Council to resolve an Aboriginal land claim. The Land Council has provided its support for the sale of the land to the Men’s Shed. 

What will happen to the current reserve for future public requirements if the sale proceeds?

If the proposed sale proceeds, the reserve will be revoked via a notice in the NSW Government Gazette.

How will the land be sold?

A proposed sale by direct negotiation with the licence holder is being considered as the best use for the Crown land given its current use, size and development.

The sale of the Crown land, if approved, will be carried out in accordance with the Sale or Lease of Crown Land by Direct Negotiations Policy IND-O-182 V3.0 and the Sale of Crown Land Policy IND-O-2 51 V3.0.

How is the value of the land determined?

Crown land must be sold at the current market value determined by an approved valuer and certified by the department’s valuation services team.

When will the department make a decision?

A decision will be made after the 28-day consultation period is completed and the department has reviewed all comments and feedback provided by the community in accordance with the procedures of the Community Engagement Strategy.  

There is no guarantee the proposed sale will progress until the findings of the Community Engagement Strategy have been reviewed and approved by the department.

How did the department consult the community?

Consultation for this proposed sale took place from Monday 30 October to Sunday 26 November 2023. During consultation, people were invited to provide feedback by making a submission via an online form or by post.

How will the department consider feedback and submissions in the decision-making process?

The department will review and evaluate all feedback received during the 28-day notification period with an emphasis on the importance that the land has and how it is currently used by the local community. 

If the community raises issues that were unknown to the department, we may need to engage further prior to making a final decision. The community’s views are important and will contribute to the final decision on the use of Crown land.
