Before you apply
- This form should be used to apply for the removal of s.77B restrictions on use of former perpetual lease land subject to a restriction under Part 4A of the Crown Lands Act 1989, pursuant to s.5.57 of the Crown Land Management Act 2016.
- This application must be submitted by the registered title holder/s or a person authorised to submit on their behalf.
- Determine if the land is within the proximity zone. Contact your local National Park & Wildlife office for further information if you haven't been able to determine this any other way.
- Prepare any relevant supporting documents you may have to support your online application form.
Supporting documentation
- A Removal of s.77B subdivision consent form (PDF, 70 KB) signed by all title holders.
- Evidence demonstrating endorsement of the State Significant Development and or evidence of the public benefit if applicable.
- Any other documentation in support of your application.
Application fee
- You will be invoiced for the application fee of $829 once your application is received.
- Application fees are updated each financial year in accordance with the Crown Land Management Regulation 2018.
- The application will be assessed and if it is determined the restriction cannot be removed, application fees will not be refunded.
- You will receive a notification letter advising the outcome of the assessment process.
- Applications are subject to assessment with no guarantee of the outcome.
