Removal of s.77B subdivision/separate dealing restrictions on a former perpetual lease online application

Before you apply

  1. This form should be used to apply for the removal of s.77B restrictions on use of former perpetual lease land subject to a restriction under Part 4A of the Crown Lands Act 1989, pursuant to s.5.57 of the Crown Land Management Act 2016.
  2. This application must be submitted by the registered title holder/s or a person authorised to submit on their behalf.
  3. Determine if the land is within the proximity zone. Contact your local National Park & Wildlife office for further information if you haven't been able to determine this any other way.
  4. Prepare any relevant supporting documents you may have to support your online application form.

Application fee

  • You will be invoiced for the application fee of $829 once your application is received.
  • Application fees are updated each financial year in accordance with the Crown Land Management Regulation 2018.
  • The application will be assessed and if it is determined the restriction cannot be removed, application fees will not be refunded.
  • You will receive a notification letter advising the outcome of the assessment process.
  • Applications are subject to assessment with no guarantee of the outcome.
